Toast Acceptable Use Policy

This Toast Acceptable Use Policy (“Toast AUP”) outlines additional terms and conditions that apply to your use of the Services offered by Toast. Capitalised terms not defined herein shall have the meaning set out in the Guest Terms of Service or the Toast Merchant Agreement as and when applicable.
You agree not to use the Services: 
  • For any purpose that violates our terms, our policies, is intentionally or unintentionally unlawful, harmful, inappropriate or objectionable; 
  • Unless you are making a legitimate bona fide Purchase. The Services may not be used to transfer money or process a Transaction that is unrelated to a Purchase;
  • To Share any User Content, that contains, offers, promotes, references, or links to information which is unlawful, harmful, inappropriate or objectionable, as determined by Toast in its sole discretion; or
  • For any Objectionable Use as described below.
You are responsible for all User Content that you upload, post, share, promote, submit, publish, distribute, store, display, or transmit (collectively, “Share”) or otherwise make available when using the Services. 
You agree and confirm that: 
  • You are the creator and owner of, or have the necessary licenses, rights, consents, and permissions, to use, and to authorize Toast to use, your User Content as necessary to provide and improve the Services and in accordance with applicable licenses to Toast; 
  • Your User Content and the use of your User Content does not and will not cause Toast to violate any law or regulation or infringe on anyone else’s intellectual or proprietary rights; 
  • You will comply with all applicable law and industry best practices including without limitation, where applicable, the messaging principles and best practices as promulgated by the relevant regulatory authority from time to time and any messaging principles and/or acceptable use policies of any applicable upstream vendor or provider of any messaging services;
  • You will not upload, post or otherwise transmit through the Services any User Content or data that contains any viruses or any other harmful programs or elements.
Prohibited content and activities include without limitation (together “Objectionable Use”):
Illegal or harmful use or content
You must not use the Services or Share any User Content that is illegal, offensive, violates the rights of others, or is likely to be harmful to others or to Toast, including without limitation:
  • Illegal goods or services, including without limitation paraphernalia that may be used for such illegal activity;
  • Lotteries;
  • Child sexual abuse material (“CSAM”), child pornography, or other illegal or restricted online content (including but not limited to simulated sexual activity, nudity, and high impact violance);
  • Sex, Hate, and Firearms, content;
  • Alcohol, unless you are a Merchant (as defined in the Merchant Agreement) licensed to sell alcohol and comply with all associated laws, regulations and licence conditions;  
  • Tobacco products, vaporizers, electronic cigarettes;
  • Marijuana, cannabis, or related products or byproducts;
  • Drugs and drug-related products, including without limitation illegal or recreational drugs;
  • Unsafe products and supplements;
  • Weapons, ammunition or explosives;
  • Adult products or services;
  • Phishing or pharming activity;
  • Scams;
  • Malicious content, such as malware or viruses; or
  • Fireworks.
  • If you are a Merchant, any of the items listed in the Payment Provider Prohibited and Restricted Services and Products. 
Misrepresentation, fraud, and impersonation
You must not use the Services for any activity or purpose that is fraudulent or contains false, deceptive or misleading statements, claims, or representations, including without limitation misinformation or impersonation, such as of a person, company, or brand, or misrepresentation of your affiliation with a person or entity.
